The charges against Sheikh Hasina

These are the five charges that are listed in the Charge Framing order that was given by the court on 10 July 2024

Charge One

(Incitement leading to widespread and systematic attack on student protesters of Dhaka University and other places of the country and thus killing hundreds and severely injuring thousands of protesters)

During July uprising 2024 commencing on 1st July 2024 and ending on 5th August 2024 you accused Sheikh Hasina, as Prime Minister of Bangladesh and the President of the ruling party Bangladesh Awami League and 14-party alliance, in a press conference on 14.07.2024 at Gonabhaban made the following derogatory and violent remarks pointing towards the protesters of ‘Anti-Discrimination Student Movement’ while demanding rational reform of quota system in government job whereby they felt defamed and aggrieved since ‘Rajakars’ are considered as collaborators of occupant Pakistan Army during liberation war of 1971 and thereafter the term has been being used to stigmatise an individual or group of individuals as enemy of the state or the people and as such they came down to the streets chaunting slogans against you and your Party and Government.

Meanwhile your subordinates, including the Cabinet Members, police and other law enforcing authorities, activists of your party Awami League and its affiliated and allied organisation got incited and inspired by your aforesaid remarks as the aftermath of which they launched widespread and systematic attack within your full knowledge upon the peaceful student protestors in Dhaka University and other places of the country causing death of about 1500 and deadly injuries to about 25,000 of them of whom many lost their eyes and other vital organs of their body.

As the Prime Minister and the President of Awami League you had command and control over the leaders, members, activists of Awami League and its associated organizations as well as followers, subordinates and law enforcing agencies and thus by your said words “XXXX” you incited them to attack the protesters throughout the country leading to death of hundreds and grievous injuries to thousands of them. Moreover, at no stage of such widespread and systematic killings and other inhuman acts throughout the country you did take any measures to prevent the commission thereof. Your such acts and inactions constituted crimes against humanity.

Charge Two

(Conspiracy, planning and order to use lethal weapon, drones and Helicopters to kill protestors)

Count 1

During the July uprising 2024 you accused Sheikh Hasina held a conversation over telephone with Dr. ASM Maksud Kamal, the then Vice-Chancellor of Dhaka University from Gonabhaban on 14.07.2025 at about 11:00 p.m. wherein you remarked that the protesters should be hanged or killed, and also informed him that you had accordingly issued  necessary orders to the law enforcing agencies including police, RAB and BGB.

Count 2

Again on July 18, 2024 you conversed over telephone with Fazle Noor Taposh, your cousin and the then mayor of Dhaka South City Corporation mentioning that you had already given direction to the law enforcement agencies to use lethal weapons to kill and eliminate the peaceful unarmed civilian protesters and also ordered them to use drones to locate the protesters, and helicopters to shoot the protesters with a view to control the movement. You also told him that you passed orders to arrest and torture the protesters across the country.

As a result of your directions the law enforcing agencies, as part of widespread and systematic attack, deployed drones and helicopters in the sky, killed many protesters including women and children indiscriminately and injured many of them by using lethal weapons from helicopters and on the ground.

As the Prime Minister and the President of Awami League you had command and control over the leaders, members, activists of Awami League and its associated organizations as well as followers, subordinates and law enforcing agencies. Thus you conspired and planned with them to kill the protesters and accordingly ordered them to kill the protesters. By such acts you committed crimes against humanity.

Charge Three

(Killing Abu Sayed at Rangpur in pursuance of incitement, conspiracy, planning and order)

Being motivated by your incitement and order police, armed activists of Awami League and Chatra League and university administrators confronted the student protesters at Begum Rokeya University in Rangpur and in furtherence thereof on 16.07.2024 at about 2:00 p.m., when unarmed students’ demonstration began in front of the university gate, police and said activists, as part of widespread and systematic attack, fired indiscriminately at the students causing severe injuries to many of them. At one stage student coordinator Abu Sayed stood unarmed on the ground and continued his protest stretching his hands. Being incited by you and under the spot instruction and supervision of Rangpur Metropolitan Police Commissioner, other police officers, vice chancellor Md Hasibur Rashid of Rangpur University and Awami League leaders, Abu Sayed was mercilessly shot at his chest several times by ASI Md. Amir Hossain and Constable Sujon Chandra Roy from a close distance without any provocation whereupon Abu Sayed succumbed to the bullet injuries.

Then his body was taken to Rangpur Medical College Hospital where the actual cause of his death was concealed. Police, with a view to save themselves, managed to lodge a First Information Report (FIR) stating false and fabricated cause of his death and also compelled the forensic expects to alter his autopsy report four times.

As the Prime Minister and the President of Awami League you had command and control over the leaders, members, activists of Awami League and its associated organizations as well as followers, subordinates and law enforcing agencies and thus by dint of your incitement, conspiracy, planning and order the aforesaid persons committed the above stated killing and other inhuman acts which are crimes against humanity. Moreover, you deliberately abstained from discharging your superior status obligations to restrain them from doing those crimes.

Charge 04

(In pursuance of incitement, conspiracy, planning and order-killing six persons at Chankharpul with lethal weapons)

The Protesters convened a program titled ”March to Dhaka” and made a clarion call to the people of all walks throughout the country to converge in Dhaka on 51h August, 2024. People of all spheres began to assemble in Dhaka from every part of the country on August 5, 2024. By your incitement, conspiracy, planning and order, a group of force with lethal weapon was deployed in Dhaka University and Chankharpul area within your knowledge under supervision and control of accuseds  Asaduzzaman Khan Kamal and Chowdhury Abdullah Al-Mamun.

Acting on wireless orders  from the then Dhaka Metropolitan Commissioner (DMP) Habibur Rahman, under the on-site supervision of Joint Commissioner of Police Sudip Kumar Chakravarty and Additional Deputy Commissioner Shah Alam Mohammad Akhtarul Islam, and under spot directives from Assistant Commissioner Molhammad Imrul and Inspector Mohammad Arshad Hossain (who have been separately prosecuted) six unarmed protesters namely; Shahriar Khan Anas, Sheikh Mahadi Hasan Junaid alias Mostakin, Md. Yakub, Md. Rakib Howlader, Mohammad Ismamul Haque and Manik Mia alias Shahrik were shot dead by Constable Sujon Hossain, Constable lmaj Hossain and Constable Nasirul Islam (who have been separately prosecuted) at Chankharpul near Dhaka University as part of widespread and systematic attack.

As the Prime Minister and the President of Awami League you had command and control over the leaders, members, activists of Awami League and its associated organizations as well as followers, subordinates and law enforcing agencies and thus by dint of your incitement, conspiracy, planning and order the aforesaid persons committed the above stated killing and other inhuman acts which are crimes against humanity. Moreover, you deliberately abstained from discharging your superior status obligations to restrain them from doing those crimes

Charge Five

(In pursuance of incitement, conspiracy, planning, and order killing 6 person at Ashulia and burning their dead bodies)

Under the conspiratorial plan, incitement and direct order from you, accused Asaduzzaman Khan Kamal, and accused Chowdhury Abdullah Al-Mamun, deployed a group of force with lethal weapon at Ashulia area on 05.08.2025 since morning and then under the direct supervision of local MP Mohammad Saiful Islam and under the direction of DIG Sayed Nurul Islam (who have been separately prosecuted), local police and armed Awami League and Chatra League activists, as part of widespread and systematic attack, opened fire on the civilian peaceful protesters in front of Ashulia Police Station and it’s surrounding area within your full knowledge causing death of five individuals, namely 1) Sazzad Hossain Sojal, 2) As-Sabur, 3) Tanzil Mahmud Sujoy, 4) Bayezid Bostami, and 5) Abul Hossain, and severely injuring one unidentified person. Thereafter Police put the dead bodies and the living one on a pedal van, and then on a police pickup truck and thereafter poured petrol on the bodies and set ablaze.

As the Prime Minister and the President of Awami League you had command and control over the leaders, activists of Awami League and its associated organizations, followers, subordinates and law enforcing agencies and thus by dint of your incitement, conspiracy, planning and order the aforesaid persons committed the above stated killing and other inhuman acts which are crimes against humanity. Moreover you deliberately abstained from discharging your superior status obligations to restrain them from doing these crimes.

Thus by the forgoing inhuman acts and inactions you accused Sheikh Hasina committed crimes against humanity as enumerated in section 3(2)(a) (g)(h) read with section 4(1)(2)(3) of the International Crimes Tribunal Act, 1973 as well as International humanitarian law punishable under section 20(2) , 20A of the Act 1973 and cognizable and triable by this Tribunal whereupon we do hereby direct you to be tried by this Tribunal on the said charges.
