Particulars of Participation

Accused No. 17: Md. Mahafuzur Rahman Shamim

You, being the General Secretary of Begum Rokeya University Chhatra League, incited violence through speeches and directions, and coordinated between student cadres, university authorities, and law enforcement to violently disperse protestors.

Accused No. 18: Md. Fazle Rabbi alias Glorious Fazle Rabbi

You, being Vice President of the said unit, mobilized armed cadres, patrolled the campus to attack demonstrators and assisted law enforcement in identifying student leaders for arrest and torture.

Accused No. 19: Md. Akhtar Hossain

You directly participated in the firing upon peaceful demonstrators on 16th July 2024, thereby causing the death of Abu Sayeed, and acted in collusion with university officials and law enforcement in suppressing peaceful assemblies.

Accused No. 20: Sejan Ahmed alias Arif

You convened meetings of student cadres to plan violent dispersal of rallies and personally took part in assaults and intimidation of student leaders on campus.

Accused No. 21: Dhananjay Kumar alias Tagor

You organized counter-mobilization against the protests, provided manpower and logistical support to law enforcement and university officials and engaged in surveillance and reporting of targeted student activists and personally took part in assaults and intimidation of student leaders on campus.

Accused No. 22: Babul Hossain

You, being Office Secretary, spread propaganda branding protestors as ..anti-state,” and encouraged collective punishment against demonstrators and personally took part in assaults and intimidation of student leaders on campus.

Accused No. 23: Md. Emran Chowdhury alias Akash alias Disha

You, being an active leader, facilitated and incited the indiscriminate firing on 16th July 2024 that killed Abu Sayeed, directed law enforcement in the torture of arrested students and commanded violent repression including campus lockdowns and intimidation campaigns. Also you personally took part in assaults and intimidation of student leaders on campus.

Accused No. 24: Md. Masudul Hasan alias Masud

You mobilized armed groups to terrorize protestors, and actively participated in planning and executing violent attacks, including unlawful confinement of students and suppression of assemblies and personally took part in assaults and intimidation of student leaders on campus.

“That, during the period between 1 July and 5 August 2024, within and around the premises of Begum Rokeya University, Rangpur [all of you]  being leaders, office bearers, and activists of the Bangladesh Chhatra League (the then ruling party’s student wing), in active connivance with state authorities, law enforcement, and university officials, and under the policy direction of the then Prime Minister Sheikh Hasina and her political and administrative apparatus, participated in, abetted, facilitated, and executed a widespread and systematic attack against the civilian student population and other unarmed demonstrators of the anti-discrimination and quota reform movement.

That, in pursuance of a common design and joint criminal enterprise, all of you committed, instigated, ordered, aided, and abetted the commission of the following crimes under the International Crimes (Tribunals) Act, 1973 (as amended)”

Charge No. 1

Count-I: Crimes Against Humanity: Murder 

That you [all], on 16th July 2024, at about 2.1 7 pm, near Gate No. I of Begum Rokeya University, Rangpur, together with others, incited and facilitated the indiscriminate shooting by law enforcement officers that resulted in the killing of Abu Sayeed, a peaceful protester and the first martyr of the July Revolution. The said killing was part of a widespread and systematic attack against unarmed civilians.

Thus, all of you have been charged under Section 3(2)(a) of the International Crimes (Tribunals) Act, 1973 and the offence is punishable under Sections 20(2) and 20A of the Act.

Count- 2 : Crimes Against Humanity: Torture 

That you [all] during the said period, instigated and supported the arrest, physical abuse and torture of numerous unarmed protestors by law enforcement agencies, in collaboration with Begum Rokeya University officials and Chhatra League activists, with the intent to suppress dissent and terrorize the student population. The acts were committed as part of a systematic policy to intimidate and punish protestors.

Thus, all of you have been charged under Section 3(2)(a)of the Act, and the offence is punishable under Sections 20(2) and 20A of the Act.

Count- 3 : Crimes Against Humanity: Persecution on Political Grounds 

That you [all] being affiliated with and loyal to the ruling political regime of the time, intentionally participated in and facilitated the persecution of students based on their political opinion and participation in the anti-quota movement. The persecution included harassment, denial of safety and exposure to violent repression.

Accordingly, all of you are charged under Section 3(2)(a) of the Act, which is punishable under Sections 20(2) 20A of the Act.

Count-4 : Crimes Against Humanity: Other Inhumane Acts

That you [all] along with others, caused and encouraged acts including disproportionate use of force, unlawful confinement, psychological terror and campus lockdowns, thereby committing inhumane acts of a similar nature intentionally directed against the civilian population.

Therefore, all of you are charged under Section 3(2)(a) of the Act, which is punishable under Section 20(2) & 20A of the Act.

Charge No. 2
Aiding and Abetting Torture

That you [all] by your leadership role in the university Chhatra League unit, actively encouraged and aided the security forces and pro-government cadres in committing torture upon students during and after their arrest, including through violent interrogation, coercive threats, beatings and denial of medical care.

That your involvement went beyond mere association-you facilitated planning meetings, identified student leaders, and personally led attacks and harassment on campus, thereby contributing to the systematic torture upo the protestors.

All of you are, therefore, charged under Section 3(2)(g) for aiding and abetting torture as a crime against humanity, punishable under Sections 20(2) and 20A of the said Act.

Charge No. 3
Responsibility for Command and Participation

That you [all] being leaders of the student wing of the ruling party at Begum Rokey University, held a position of influence, command, and coordination; and that you actively participated, abetted, and provided moral and logistical support to crimes committed by others including security forces, university officials, and student cadres. Your complicity included both direct actions and failure to prevent such crimes despite being in a position to do so.

Thus, all of you are liable under Sections 4(1), 4(2), and 4(3) of the Act, and the offences are punishable under Sections 20(2) and 20A of the Act.

Charge No. 4
Joint Criminal Enterprise and Conspiracy

That you [all] acting in concert with other co-accused persons, university officials, and law enforcement officers, formed a joint criminal enterprise to suppress the protest movement by resorting to crimes against humanity, including murder, torture, persecution, and other inhumane acts, thereby participating in a criminal conspiracy m violation of the International Crimes (Tribunals) Act, 1973.

Accordingly, you are charged under Sections 4(1),4(2),4(3),20(2) & 20A, which provides punishment for conspiracy, abetment, and complicity in the commission of offences under the Act.
